Terms & Conditions
It is mutually agreed that the following terms of agreement form an integral part of your booking and that no variation or modification of these terms and conditions shall be effective unless accepted by Burhan Khan Photography in writing.
BOOKING FEE:
A deposit of R3000.00 is required separately for photography and videography when the client signs this booking form. Dates are reserved only when this deposit is paid by cash or EFT. A full unconditional refund policy exists for a period of 14 days from receipt of the contract and payment.
CANCELLATION AND POSTPONEMENT:
When you reserve your date with the photographer, he begins to decline other events for that date.
For this reason, the following applies:
If the client postpones the event after the contract is completed the deposit of R3000 will be retained as a cancellation fee.
If the client postpones the event but wishes to retain the photographer for a future date the R3000 deposit will be retained for the future event which will be at the discretion of Burhan Khan Photography.
PAYMENTS:
Payment of the balance of the photography fee is to be made not later than 14 days prior to the wedding ceremony.
An invoice will be despatched to you approximately 4 weeks prior to your event as a reminder.
WEATHER CHANGES:
Weather permitting, the wedding photographs will be taken as agreed. In the event of rain or snow or any form of weather disturbances, the photographer will make the necessary changes in the photographic session and will not be responsible for any disappointment caused by the weather. However, the photographer will do his best to produce coverage of the wedding within the time allocated to him.
COVERAGE & SCHEDULE:
The photographer cannot be held responsible for the lack of coverage caused by the bride, the groom or the wedding party not being on time. The photographer does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement. The photographers shooting schedule, style of working and experience are designed to achieve a great set of wedding photos for the Clients. Both the Clients and the Photographer therefore agree that punctuality and cheerful cooperation are essential to producing outstanding photographic results. In cases where the wedding does not run on time (for example, extreme lateness by one of the Clients and or any of their other service providers.) the photographer cannot guarantee to take a normal set of photos although in such circumstances he will do the absolute best to compensate.
COOPERATION:
The Clients and the Photographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract. The Clients also agree to give the Photographer sufficient warning of key events at the wedding to give the Photographer time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at weddings like having their photo taken. In such cases the Photographer will use his discretion but cannot be held responsible for a lack of photos of these people.
LIMIT OF LIABILITY:
If a photographer is too ill or becomes injured and cannot supply the wedding services specified above the Photographer will try to book a replacement wedding photographer. If another photographer is unavailable and a replacement photographer cannot be found then liability is limited to a refund of any payments received. The Photographer has working methods in place to prevent loss or damage to your images.
However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.
PHOTOGRAPHERS MEALS:
The Client(s) is required to provide meals for the Photographer and one assistant (if applicable) during the time when the meal is being served to the wedding guests. These may be served in the dining room or at another location in the reception venue. Further arrangements and the practicality of this arrangement will be as discussed between Clients and the Photographer.
PAPARAZZI GUESTS:
All your guests will have digital cameras and all your guests will want to photograph the Clients. In the spirit of cheerful cooperation the Clients agree to give the Photographer precedence over the guests in order to take the photographs required for the wedding services described above. The photographer cannot be held liable for a lack of wedding photos if guests taking their own photos of the Clients continually interrupt the photographer's work.
COPYRIGHT LAW:
The copyright of photographs remains with the Photographer. The Photographer grants the Clients permission to make copies of the images under the following conditions. The images taken by the Photographer are for personal use by the Clients and their friends and relatives. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from the Photographer. The Photographer may use photographs for self promotion on social media platforms only with explicit permission by the client.
